2. Registers and Records

  • Business is governed by certain regulations which cover a lot of legal aspects in connection with employee-related matters covered by laws under Central and State legislation. Keeping this in view, management of labor laws play an important role in terms of what are the various types of information to be maintained by the employers and shared with the Governmental authorities when a visit is made for this purpose for scrutiny of records.
  • Records need to be maintained under Payment of Wages, Minimum Wages, Payment of Bonus Payment of Gratuity, Provident Fund, ESI, Maternity Benefit, Employee Compensation, Labour Welfare, Industrial Disputes, Employment Standing Orders, Equal Remuneration, Apprentice, National Holidays and Sexual Harassment to name some and the list is not exhaustive.
  • Non Compliance may end up in legal action by way of penalty, imprisonment, etc and may not be a good sign of Corporate Governance which is an essential part of a good value system that needs to be nurtured by all Business Houses.

3.Remittance Management

  • With regard to E.P.F the following will be our responsibilities:

    a) Registration of new Establishment: In case if your factory/establishment has not been covered before, we assist you by putting forth the application form through proper channel and thereby registering your firm/company under the act.

    b) Registration of your employees: We will be supplying with nomination forms to your employees and thereby registering their names under P.F. Scheme & pension scheme. Fresh nomination forms will also be supplied by us in case the employees require any change in the nomination.

    c) Preparation of Challan: we will prepare monthly remittance challan Assessing the liability from your salary/wages/other related documents within the due date. We will also be remitting the challan in the bank in case of requirement.

    d) Preparation & Submission of Monthly Returns: We will be preparing monthly returns and submitted the returns within the due date.

    e) Preparation of Annual Returns: We will be preparing annual returns in the prescribed form and submitting it with the concerned office in time.

    f) Preparation of Settlement forms: We will be preparing Settlement forms for the employees who quit employment.

    g) Representation at the time of Inspection: Our representative will be there to show all the records required to be produced to the concerned officer at the time of inspection.

    h) Information’s & Advices: Information’s with regard to any amendment/changes in the act will be informed immediately. We will also give advices to employer wherever necessary.

  • E.S.I : The following will be our duties with regard to maintaining records & registers under the scheme:

    a) Registration of your establishment: In case your factory/establishment has not been covered before, our representative will be assisting you for registration as per the requirements under the act.

    b) Registration of your employees: We will be supplying you with the forms required for registering your employees under the act and we will be arranging to get the identity cards from the concerned office. For registering the identity card with the concerned dispensary necessary forms will be supplied by us.

    c) Changes/Alteration in the identity card: We will be supplying with necessary forms under circumstances wherein your employee might have changed in his residence/wants to include any additional family member name in the identity card.

    d) Preparation of Challans: We will be preparing monthly remittance challan by assessing the liability as per your salary/wages/any other documents maintained by you. We will also remit the challan in the bank in case required.

    e) Preparation of periodical Returns: We will be preparing periodical returns as required under the act. We will be submitting the returns within the due date (if remittance is done within time).

    f) Information & Advices: We will providing with information required by you and we will also advice the employer in complying with the act with regard to maintenance of General Ledger. Whenever any amendment is made in the act we will inform the employer immediately.

    g) Representation at the time of Inspection: Our representative will be there to assist at the time Of Inspection conducted by the inspectors of the corporation. We will be showing him all the records related to the act (except General Ledgers, cash book & vouchers).

  • Professional Tax:

    a) Registration of Establishment: We help the employers to register their Establishment to register & remit the dues in time.

    b) Maintenance of Registers: We maintain all Registers as prescribed under the act and assist the employers to produce the records at the time of inspection.

    c) Information & Advice: Any changes/amendment will be well informed to our clients and they will be abreast of the changing laws & regulations as & when changes occur related to Labour acts & rules.

  • Labour Welfare Fund:

5.Compliance Risk Management – we carry out assessments to identify different types of organizational risk for our client & help them not only to avoid future legal consequences but also minimize cost which they make without knowing the facts. Planning, Organizing and Establishing the Audit objectives within the scope of the work entrusted by esteemed clients, forms the basis for examination of document: in the most dutiful manner so as to determine the risk together with the compliance health state of an Organization. Thereafter the process of onsite Audits happen by personnel interactions, reviewing records an making observations with a tripartite signing of the evaluation in the case of Vendor Audit by Vendor’s Representative, Client’s representative and the Auditor while in the case of Entity, it is between the Client’s representative and the Auditor.

  • Entity Audit – Principal Employer’s audit comprises of a compliance checklist agreed upon by the Organization for physical verification of labour law compliances on a monthly or quarterly basis and to escalate non performance issues and areas of concern to the Management for resolution which includes periodic filing of returns under the various Acts.
  • Vendor Audit- Vendors are looked at, as Service Providers under a Service Agreement with the Principal Employer for various service deliverables which comprises of a vendor checklist where compliance documents are physically verified to assess the status of vendors main contractors or sub contractors offering services like Security, Housekeeping, Maintenance, IT, Transport, Gardening, Cafeteria etc.
  • Special Audit – In case of Special requirement to analysis Annual Compliance of Entity/ Vendor.
